SEQUEL TO DRAINAGE WORK.
CLAIM AGAINST BOARD.
Matters in connection with the claim of David Kenneally (Mr. Burton) against the Auckland and Suburban Drainage Board (Mr. T. Cotter, K.C., and Mr. Bagnall), for £1100 in connection with the drainage operations .of the board, were discussed at the Supreme Court before Mr. Justice Cooper and the assessors last evening. The land which plaintiff alleges has been depreciated in value owing to the construction of the sewer does not all immediately adjoin the sea, as a road runs through the block, the larger portion of which is on the far side- of the highway. It had been decided previously that the point of law as to whether a claim could be made in respect to this latter land should be discussed by the Court of Appeal, but owing to the Court being otherwise engaged, it had not been brought forward.
It was decided last evening that the Court should make a conditional award in regard to the two portions of the block, and that the point of law raised should be referred to the Court of Appeal at a later date. His Honor then adjourned the proceedings until Monday, May 26.
