PREFERENCE TO UNIONISTS.
A UNION'S RULES DEFECTIVE, (BY TKLKGnArir.tress association - ,) Ceeistcittkcb:, Sunday.. The opinion of the Arbitration Court has been received in regard to a case stated bv Mr. V. ,G. Day, S.M., at Timaru. The case was one in which the inspector of awards proceeded against George D. Hansford, seeking to recover from, defendant £10 as penalty for a breach' of the Timaru carpenters' award, the breach being that defendant engaged a man named Orr, who was not a member of the union, and that ho failed to notify the inspector of awards within 24 hours of engaging Orr. Tho opinion given by Mr. Justice Sim is as follows:—"Members of the Timaru Industrial Union of Workers are entitled to preference of employment, but only if the rules of the union comply with the requirements of clause 12 of the award. Tho rules plainly do not comply with tho requirements of that clause, and members of tho union are not entitled to preference of employment. The position is the same with regard to the rules of tho Timaru branch of the -Amalgamated Society of Carpenters and Joiners, which is referred to in clause 12. (f) of the award. Defendant therefore, has not committed any breach of -tho award."
