MAGISTRATE'S COURT.

A TIMBER DISPUTE. A c;j,Aixr under the Lien Act for the sum of £190 7s 3d, was brought against Henry Campbell Hay and the Official Assignee. by the Kauri Timber Company, before Mr. C. C. Kettle. S.M., at the Magistrate's Court, on Saturday. Mr. J. B. Johnston appeared for tho Kauri Timber Company, and Mr. P. Spencer and Mr. Selwyn Mays for Mr. Hay and the Official Assignee respectively. The sum claimed was alleged to bo due as representing the value of timber supplied to Albert Riggs, now a . bankrupt, who was the contractor for tho j erection of a house at Devonport for Mr. Hay.

For the plaintiffs it was contended that the timber was supplied under a continuous contract, which gave tho company the benefit ..of the Lien Act up till Juno 12. After this date no timber had been supplied. This argument was disputed by Mr. Mays. The magistrate eventually reserved his decision.
