ASSAULTING AN ENGINEER. CONTB ACTOR FINED £5. [BY TELEQU: TV —OWN CORRESPONDENT.] Tb Aroha, Friday. A charge of having assaulted Mr. W. R. Johnson, the Piako county engineer, was brought against Thomas Knox, a road contractor, at the To Aroha Magistrate's Court yesterday. Mr. F. V. Fraser, S.M., occupied the Bench. The defendant was alleged to have struck the complainant with a stone, inflicting serious injuries to his head; ■ From the evidence it appeared that on April 10 the engineer visited the county .stoneMcrushing- works at Stone' . - Creek; when, the defendant accused him of not keeping up the supply of metal, Hign words ensued, and . Knox challenged Johnson to fight. Johnson, by way of reply, put his fingers to his nose, and Knox, who had worked himself up into a tem- ' per, picked a heavy stone and threw it at Johnson, who wae struck down and rendered insensible. Dr. Kenny's evidence showed that this injuries were, painful and somewhat serious, the hearing of one ear being greatly affected. The defence was that Knox suffered great provocation.. - "

The magistrate held that a gross assault had been committed, and fined Knox £5, with costs. Johnson could, ho said 4 still proceed for civil damages.
