COUNCn, TO PAY DAMAGES.

[BY TELEGRAPH. OWN 1 CORRESPONDENT.] Wiiangarei, Thursday. An Assessment Court, comprising Mr. F. V. Frazer, S.M., assisted by Messrs. H. R. Cooke and Jas. McCarroll (assessors), sat for eight hours yesterday to consider a claim made by a local property-owner for £100 against the Whangarei Borough Council for alleged damage to his property, caused by the local body carrying the sewerage system through his grounds, and constructing a manhole close to the claimant's house. The case had an important bearing to all other ratepayers and property-owners in the borough.

A great deal of evidence was heard, and the magistrate and the assessors inspected the site. The claimant was awarded £25 damages, and the Borough Council was ordered to make certain alterations in regard to the completed work. Both parties were ordered to pay their own costs.
