A BETTING CHART.

. [BY TELEGRAPH.— ASSOCIATION.] , • Wellington, Wednesday. Reserved judgment was given by Mr. W. G. Riddell, S.M., to-day in the case in which the police proceeded against William Scott and Henry Martindale for a breach of the Gaming Act:

Tho defendants were charged with having published a certain document containing a notification as to betting on horse races to be held at Auckland on June 3 and 5, to wit the Great Northern Hurdles t and the Great Northern Steeplechase. It was proved that defendants were bookmakers and commission agents resident in Welling-".'' ton, and that a letter enclosing a card endorsed " Scott and Martindale, woolbrokers, Wellington," and a double chart containing tho names of the horses engaged in the Great Northern Hurdle Race and the Great Northern Steeplechase was received by Mr. Mowlem, Palmerston. North, in May last. " I think that the result of the evidence tendered is to create a prima-facie case against defendants," said His Worship, "and to throw upon them tho onus of showing that they have no connection with tho double chart enclosed in the letter to Mowlem. They have not discharged this onus, arid in my opinion it must be held that they are guilty of tho offence charged in the information."

Each. defendant was fined 30s, with costs and witnesses' expenses. Mr. P. W. Jackson, who represented Mr. Wilford, asked that the fine be increased, so as to permit of an appeal on the facts. His Worship, however, refused to do this, stating that the facts were perfectly Bimploj and that ho had drawn certain deduction from. them. Security for an appeal on law, however, was lixed. at £8 Bs.
