. WAtHr, Wednesday. At to-day's sitting of the Warden's Court Mr. F. J. Burgess, Warden, delivered judgment in the case in which J. Keane, of Waihi, contractor, claimed the £378 12s from the Waihi Gold Mining* Company for alleged damage to his property by the flooding of the Ohinemuri River, said'to have been caused by the company's dam near the Union mill. Mr. Mueller appeared for plaintiff, and Mr. Jackson for the defendant company. The Warden dismissed the plaintiff's claims for forfeiture of the license under fraudulent misrepresentation and for abandonment of that portion of the dam over sft. On the question of damage to property, Mr. Burgess . held that the dam had been responsible for certain damage and allowed damages in all amounting to £73 7s, with costs, £11 18s.
