ROAD MAKING.

A LEGAL POINT. [by telegraph.—press ASSOCIATION.] Invkrcargill, Tuesday. At the Supreme Court to-day the trustees of the late J. T. Thomson, in a suit against the members of the Southland County Council, asked for an order interpreting section 116 of the Public Works Act, 1908, and declaring whether the plaintiffs were liable to cover with gravel certain roads laid out by them in subdivision of suburban land in Invercargill. Plaintiffs admitted that they were bound by law to form the roads, bat contended that they were not obliged to gravel them. Defendants maintained that the meaning of the word " form" ,in the Act was to make the road and finish it by gravelling. '] The judge tbeld that there was a distinction between the words forming and gravelling when used in connection with road making, and interpreted the section in .favour of the plaintiffs.
