In its report of the case, Shiel and Co. v. the Union Steam Ship Company, the Otago Daily Times says when the case was called oil Mr. Uurnard, for the plaintiffs, said it was brought as a teat with a view to ascertain the liability of the shipping company in ,'ases where damage arose through pillaging of fruit or other goods. For years past it had been the practice of the company to refuse to pay damages arising from pillaging", and. as a result, produce merchants in some instances had lost as much as from £5 to £6 per week from this cause, Plaintiffs in the present coae had applied for Mid had been refused' payment for loss sustained, and he (Mr. Burnard) had advised that the company w/is liable. It was understood between the parties that the company intended to test the case, but he had been informed by counsel on the other side that this was not to be done, and that the amount claimed had been paid. The company, under the old form of bill of 'ading, claimed' that it was not liable, but under the interpretation proviso now added he held that there was liability. His Worship (Mr. Widdowson) : Will the result of the case be the means of stopping pillaging?" Mr. Burnard: "I think it will tend in that direction." His Worship: "A criminal prosecution would be more effective." Mr. Burnard : " I understand the company intimated that if these proceedings were successful, and similar proceedings were persisted in, the freights would be increased so as to cover the risk. It will make the company take greater care to proteV itself against leas for pillaging. The claim is only one of a number, and my clients intend to proceed with other claims for damages."
