GUMDIGGERS' LIMITATIONS.

Daroaville, Wednesday. Jtinc.Mic.vr was delivered yesterday, by Mr. 11. W. Dyer in a case heard on January 28. Last year Mitchelson Bros. sold the Babylon flax lease to Williams, Marriner and Co., the price being about £45,000, On the property were working 600 Austriaus, to whom Mitchelson Bros, nad granted a permit to gum right*-. The test case was brought to decide whether the purchasers were bound by the permits, and £10 was claimed as trespass. Mr. Coales represented plaintiff and Mr. Sharpies (Auckland), with Messrs. Hayes and Field, appeared for the defendants. The Court was crowd, d with all the Austrians concerned. The case Lasted a day and a-balf.
His Worship, in a. lengthy judgment, held that the Austrians had gone beyond the original boundaries, that the permit had been properly cancelled, even if binding on the purchasers, and, therefore, no claim to title arose. Judgment was given for plaintiffs for £10, and costs £4. Leave to appeal was granted.
