WnA.VGARKi, Thursday. AT the Magistrate's Court yesterday Louis Colqulioim was charged with. assaulting Ueorge Hirst by striking him on the faee with hie fist. Informant stilted that-, having a cheque to cash, lie went to the Whaugarei Hotel, and while standing: at (lie bar was called out by defendant, who demanded from him hulf-a-sovereign, which Col.|iilioun alleged was due him. Hirst asked defendant how the debt had been contracted, and, receiving no reply, said if the information was not. forthcoming the debt would be owing for life. Thereupon, without further provocation, detendant struck him violently in the face. Col<|iihoun admitted the blow,' hut wild informant owed him money as a card debt. On his asking for it Hirst, had called him names. This caused Hie assault, ami he only regretted he had not struck harder. Evidence vas also given by several witnesses, and the Bench, after a brief retirement, Mid there had been ianlts on both sides, and the cafe would therefor:! hi; dismissed, won party to pay his own oosl» The legal difficulty regarding the formation of Second Avenue has been overcome, and ilie work will be started as toon as the property-owners pay their contribution*.
