The practice of himself and the other judges was that when tho accused had given evidence and that evidence was not believed by the jury, such eases could not come under the Probation Act. The sentence would bo a. nominal on©, considering the nature of the offence. The prisoner was sentenced to six months' imprisonment with hard labour.
