ALLEGED INFRINGEMENT OF RIGHT.

Wellington, Tuesday. The nonsuit point in the case arising out of an alleged imitation of official race cards for the Wellington Racing Club's Hummer Meeting was decided by Dr. McArthur, S.M., this morning, in favour of the plaintiffs. The proceedings were instituted by Cooks-ley and Harrison against Johnson and Sons, for the recovery of £100. Counsel for the defence had asked for a nonsuit, and, in doing so, alleged that defendants had produced their book as the result of independent work. He contended that it, had been shown from the plaintiffs' case that, it was possible to produce work similar to that of plaintiffs' and of fair accuracy, and that, therefore, there was no copyright in plaintiffs' book. His Worship upheld plaintiffs' contention that a prima facie case »f infringement had been mad* out, and required an answer from defendants. The application was therefore dismissed, and the case adjourned until Thursday for further heaving.
