TO LOUIS PIERRE DUGLEAUX. formerly of Auckland, in the Provincial District of Auckland, in the Colony of New Zealand, Baker. WHEREAS ELLEN DUGLEAUX. of Auckland, claiming to have been, lawfully married to you, has tiled her petition against you in our said Court, pmying for dissolution of her marriage with you, wherein she alleges that you have wilfully deserted hei during the period of five (5) years and upwards. Now this is to command you that within twenty-eight days after publication of " a copy hereof, and of a copy of the above petition in the NEW ZEALAND HERALD and the Auckland Star newspapers, both published in the City of Auckland (inclusive of the day of such publication), you do appear in our said Court then and there to make answer to the said petition. And take notice that in default of your so doing, the said Court will proceed to hear tha said charge proved in due course of law, and to pronounce sentence therein, your absence notwithstanding. And take further notice that for the purapso aforesaid you are to attend in person or by your solicitor at the Registrar's Office at Auckland, and there to enter an appearance, without which you will not be allowed to address the Court either in person oi by counsel at any stage of the proceedings in the cause. The Petition of ELLEN DUGLEAUX, of Auckland, in the Provincial District of Auckland, sheweth— 1. That your Petitioner was on the twentysixth day of July, 1874, lawfully married to Louis Pierre Dngleaux. then a baker at Gisborne, in the Provincial District of Auckland. 2. That after her said marriage your Petitioner lived and cohabited with her said husband at Gisborno aforesaid, at Opotiki in the said Provincial District of Auckland, and in Auckland aforesaid; and that your Petitioner and her said husband had issue of their said marriage one child, to wit Louis Leopold Dugleatuc, who was born at Gisborne aforesaid on the 20th day of April, 1875. 3. That the said Louis Leopold Dngleaux died at Gisborne aforesaid on the 17th day of March, 1873. 4. That the said Louis Pierre Dugleaux on or about the 15th day of August, 1890, left Auckland without informing your Petitioner of his departure or his destination or giving your Petitioner any information whatever in regard thereto, and leaving your Petitioner entirely without means of support. 5. That your Petitioner has since the said 13th day of August, 1890, maintained herself by her own industry entirely without any support wbatevci from the said Louis Pierre Dugleaux.

6. That in the month of June, 1896. your Petitioner received a, verbal message purporting to come from the said Louis Pierre Dugieaux that the said Louis Pierre Dugleaux was in Auckland and desired an interview with your Petitioner, but in view of his previous conduct your Petitioner replied declining to see him unless in the presence of a solicitor. Your Petitioner then received a further message that the said Lonis Pierre Dugieaux refused to see her under these conditions. . 7. That your Petitioner heard nothing further and believes the said Louis Pierre Dugieaux thereupon left Auckland, and your Petitioner has not seen or heard from the said Louis Pierre Dugieaux since the month of June. 1896, although your Petitioner has made such inquiries as she has been able to do, and your Petitioner has now no knewleclga of the whereabouts of the said Louis Pierre Dusleaux. 8. That the said Louis Pierre Dugieaux has since the said 13th day of August, 1890, and without just cause wilfully deserted your Petitioner, and without any such cause left her continuously so deserted during the, period of five years and upwards. 9. That your Petitioner has since the 13th day of August, 1890, been domiciled in the Colony of New Zealand. ••< Your Petitioner therefore humbly prays that your Honor will be pleased to decree that the said marriage .be dissolved, and that your Petitioner may have such further and other relief in the premises as to your Honor may seem meet. ELLEN DUGLEAUX, the Petitioner named and described therein, make oath and say— 1. That the matters alleged in the foregoing Petition are true. 2. That no collusion or connivance exists between the said Louis Pierre Dugleaux and myself. Sworn at Auckland aforesaid this 21st day of April, 1902, before me, H. DEAN BAMFORD, a Solicitor of the Supreme Court of New Zealand.
