A PECULIAR CLAIM.
«►_ [it Y. TELEGRAPH.OWN' CORRESPONDENT. ] Coromaxdel, Wednesday. A peculiar claim was heard before the Magistrate's Court to-day, Messrs. Rhodes and Rock li fie presiding. Arania Hapi, a native youth, sued F. X. Cock for £2 Los 2d, for balance of wages for scraping gum. Mr. Cruickshank appeared for plaintiff, and Mr. C. R. Walker for defendant. It appeared from the evidence that plaintiff had been convicted of stealing some of the kauri gum lie was supposed to be scraping for defendant during the period for which he was claiming wages. The total value of the gum admitted to have been stolen by plaintiff was £4 5s (more than the wages due). Mr. Cruickshank contended that plaintiff* was entitled to judgment, having served a term for his offence. Mr. Walker, for defendant, contended that plaintiff had helped himself to more than his wages by stealing the gum, and apart, from any legal point that judgment should be given against plaintiff under the equity and good conscience clause. The justices gave judgment for the defendant, «8 contended by Mr. Walker, with costs 21s.
