Collector of Customs, an action brought for recovery of £300, paid as poll tax on three Chinese seamen who deserted from the steamer Indralema and evaded recapture. His Honor held that the payment had not been voluntary, under a mistake of law, and defendant having paid money over to the Treasury, could not be sued.
