SUPREME COURT.— Sittings. [Before His Honor Mr. Justice Conolly.] The civil sittings wore resumed yesterday morning. DISCONTINUED. Albrecht Jeppo v. Lewis Moses: This was a claim to set aside an order upon * judgment summons, alleged to have been obtained by fraud in the Magistrate's Court, and for damages for imprisonment under tho said order. Mr. J. R. Reed (instructed by Messrs. Gillies and Colbeck) appeared for the plaintiff, and Mr. Theo. Cooper (instructed by Mr. Lundon) for the defendant. Upon the case being called on to-day. Mr. Reed stated that the option would bo discontinued. He explained that Mr. Cooper had shown him a letter from the firm of which the plaintiff had been a member, which letter completely cut the grouud from under tho plaintiff's case. This letter was not known to have been written by either himself, tho plaintiff's solicitors, or tho plaintiff himself personally, but there was no doubt he was bound by tire contents. His Honor said he would accept tho statement of counsel that the action would be discontinued. DIVORCE. Samuel Marks, restaurant-keeper, of Queenstreet, Auckland (petitioner), and Ellon Marks (respondent): In this case the petitioner applied for a decj-eo nisi dissolving his marriage with the respondent, under subsection 3, of section J, of tire Amending Act of 1893, 011 the grounds that b!io had, during four years and upwards, boon an habitual drunkard, had habitually neglected her domestic duties, and renderod herself unfit to discharge them. Mr. F. E. Baume appeared for Marks, and called several witnesses in support of the petition. There was 110 appearance of the respondent. His Honor granted the decree as prayed. This is the first case, under this particular subsection, that has been heard in the colony. The Court resumes at ten o'clock this morning.

Patrick McDonald, £2 2s 6d, with costs 10s: W. O'Brien v. Wm. Adams, £1 10s, with costs ss; Annie Drait (Mr. Williamson) v. J. Williams, £110s 9d, with oosls ss; Thomas Usslier (Mr. KeotIcy) v. Alex. Boyle, £50, with costs £3 12s.

POLICE COURT NEWS. The silting at Ilia Police Court yesterday was a brief one, Mr. J. H. Hammn, J.P., being on the Bench. John William Robinson was fined 10s, or 45 hours in default, for drunkenness, and Walter Trayos and William Wainhouse, for a like offence, were each fined ss, and Joseph Robinson, likewise charged, was cautioned and discharged. ONEHUNGA POLICE COURT. At tho Onehunga Police Court yesterday, before Dr. W. R. Olose-Erson and Mr. H. Wilding, J.P.'s, a young man named Samuel Jackson was ohargod with being drunk, assaulting tin; police, and resisting tho polico. Sergeant Greeno deposed to tlio defendant being drunk in Queen-street at about two o'clock yesterday morning, when he and Constable McNamara arrested him. For tho first offence Jackson was fined ss, or in default 48 hours, and one month's imprisonment each for tho other offences.
