Wilfred Ewing Bruco and William Richard Holmes, liquidators of the Montezuma Mining Company. In this case plaintiffs claimed £154- 9s 8d for goods supplied to defendants, and as a set-off there was a counter-claim for £165 on account cf the sale of an aerial tramway. Mr. Baume appeared for the plaintiffs, and Mr. Gampbell for defendants. Formal evidence was given by Percy A. Hadley as to the sale of goods. His Worship reserved his decision. OWNERSHIP OF A DOB. '■ Joseph Thorpe, of Epsom, labourer, v. Thomas Hill, of Epsom, labourer; In this case plaintiff claimed to bo the owner of a St. Bernard bitch and four pups, of the value of £5, at present in the possession of de- ' fendant, and which defendant refused to deliver up to plaintiff. Plaintiff therefore claimed the animals, or, in the alternative, £5, and £1 damages for their detention. Mr. Colbeck appeared for» plaintiff, and Mr. Mahony for defendant. The statement of defendant was a material denial of the allegations, on the grounds that he had bought the clogs and paid for them. His Worship : held that plaintiff had not made out his j claim, and a nonsuit was entered, with costs £2 16s Bd. RESERVED JUDGMENT. His Worship gave his reserved judgment in the case Messenger Bros. v. W. Sail ford and Sons, in which plaintiff claimed iii, being the price of 64 crates of oranges belonging to plaintiffs, and converted by the defendants to their own use, and £16 general • damages, His Worship found that the oranges were sold by Mr. Grove to the plaintiffs, and . not to defendants, and that when defendants knew that Messrs., Messenger • Bros, claimed the oranges they should hava ' seen Mr. Grove, and had the matter cleared up Judgment was therefore given for plaintiff for £32,. the price of the oranges, and £2 damages, with costs.
