COURT OF APPEAL

[BY miQßiM.— ASSOCIATION.] Wellington, Thursday. The appeal in Wasteheys v. Wasteneys was dismissed, the judgment of Judges Williams, Denniston, and Conolly being

read by the Chief Justice. The Court concurred in the finding of the Chief Justice on the question of adultery of the wife, and held bet conduct prior to execsion of the deed of separation was a schema to obtain freedom of action and an incomo, that although her husband's suspicions were not entirely removed by her assurances they were much shaken, and that if he had known all he would nob have signed the deed. The deed was not binding as a compromise of a suit by the wife, the then pending suit being part of tho scheme, and, therefore, tainted with fraud. The appeal | must, therefore, fail.
