A CURIOUS LEGAL POINT.
[BY TELEGRAPH,— ASSOCIATION.] Dijnedin, Saturday. A case in which the element of time enters largely came before the Supreme Court) today. On the 18th January two persons waited outside the office of the Mining Registrar, at Clyde, each with an application for the right to construct a water-race on land, which only that day became open for application. Punctually at nine the office was opened, and while one entered the room with the. registrar, the other waited. The Registrar marked both applications 9.1 a.m., but as it was 9.8 before the second application was in the Registrar's hands, the first man is taking proceedings to compel the Registrar to give a certificate as to the time. The Registrar pleads ho can only deal with one application at n time, and as both applicants attended together, he considers tho applications were simultaneous. Judgment was reserved.
