Lewis Lyons Levy v.. Samuel Cochrane and Son.This was a claim to recover possession of a chattel or its value, £2 5s and damages, 10s. Mr. Gittos appeared for the plaintiff, and Mr. Cooper for the defendants. In this case the plaintiff claimed a saddle alleged to have been detained by defendants. The evidence submitted showed that the plaintiff, who is a second-hand dealer, had, bought a saddle from a man and afterwards put it into Cochrane's piart, where it was claimed by another party as his property. Messrs. Cochrane and Son gave up the saddle to the claimant without giving notice to Levy. His Worship gave judgment for the defendants, with £3 costs. Arthur P. Wilson v. C. S. S. George. —Claim, £22 10s. Mr. P. Earl appeared for the plaintiff, and Mr. W. A. Bruce for the defendant. The plaintiff, who was an architect, carrying on business in Auckland, claimed the above amount from the defendant for sketches prepared and approved of, and other work done in connection with a house that Mr. George proposed to build at Lake Takapuna. His Worship gave judgment for the plaintiff for the amount claimed with costs £5 Is. James Hayden v. Mrs. Gallagher.— Claim 16s, amount of wages alleged to be due. Mr. P. Earl appeared for the defendant. The plaintiff deposed that he was engaged as second cook at the Grand Hotel on the 29th August. On the 6th of September he was paid off by Mrs. Gallagher. He claimed a week's notice.' The defendant contended that she had only employed the plaintiff on trial, and not suiting, she dismissed him at the end of the week. His Worship nonsuited the plaintiff. No costs were asked for.
POLICE COURT.— [Before Messrs. S. "X. Collins, W. Dinnison, and YY. Earle, J.P.'s. ] Shop-lifting. —An elderly man named Frederick Wills was charged with having on the 12th September stolen one pair of boots of the value of 15s, the property of Benjamin Sergeant Gamble conducted the prosecution. The accused pleaded not guilty to stealing the boots, but admitted having picked them up on the footpath. The Bench sentenced the accused to one month's imprisonment with hard labour. Alleged Wife Desertion.—A young man named Patrick Casey was charged with having on the 18th June, at Onehunga, unlawfully deserted his three children under the age of 14 years. The accused was remanded to Saturday, bail _ being allowed, himself in £10 and two sureties of £5 each. Alleged * Threatening Language.—A young man named William Thomas Jackson was charged with having on the 11th September used certain threatening language towards one James Jackson. After hearing the evidence the Bench ordered the accused to be bound over to keep the peace for three months, himself in £20 and two sureties of £20 each. WHANGAREI S.M. COURT. / Wednesday, September 5. [Before Mr. R. S. Bush, S.M.] ' Whitelanv's Estate. —The Official Assignee v. Jdolton : Mr. McAlister for plaintiff ; judgment by default, £2 3s and costs. Ditto v. ; Dickey: Judgment confessed. Ditto v. C. J. Rasmussen : Judgment for £2 153 0d and costs. Ditto v. Clotworthy, sen. : Claim, £4 10s; judgment for £3 2s 6d. Ditto v. Clotworthy, jun.: Claim, £1 14s; judgment for £1 Is. Ditto v. Saunders : Claim, £12 6d; judgment by default, and costs £2 4s 6d. Ditto v. Hirst: Claim, £7 2s 2d; judgment by default, and costs £2 7s. Ditto v. Dent: Claim, £7 Is; judgment by default, and costs £2 9s. E. Jones v. Wright.— £2 14s; judgment confessed. September 6.
Charge against Robert Rose Forsyth. —The accnsed was charged with the larceny of the sum of £14 8s 9d, the property of James Whitelaw. Mr. J McAlister for the prosecution, and Messrs. Carruth and Steadman for the defence. John Lawson, Official Assignee, deposed that in examining the books of J. Whitelaw he found a deficiency of £14, and in consequence brought the above charge. James Whitelaw deposed that he owned the contents of the Towai store, and that the accused carried on the business there on witness's account. Lengthy details of matters of account were given", and witness was cross-examined by Mr. Carruth at considerable length. Evidence was also given by F. F. Day, Thomas Nadin, and W. A. Bessell, who was accountant for J. Whitelaw, after which accused was committed for trial at the next sittings of the Supreme Court, bail being allowed, nimself in £100, and two sureties in £50 each.
A Second Charge.— charge of embezzling the sum of £2 13s, on the 12th January, 1893, the property of J. Whitelaw, was preferred, and evidence given by J. Lawson, Official Assignee, J. Whitelaw, Neville Newbold, F. F, Day, late manager for Mr. Whitelaw, after which the charge wa3 dismissed.— [Own Correspondent.]
