ONEHUNQAPOLtCECOURT.-ToESDAr. , ' (Before Mr. B. S. Bosh, B.M.] AN Affiliation Case. —John Clarke appeared to answer, 4 summons charging him with tailing, to provide for the maintenance of his female illigibimate child, of which Theresa Constance was . the ? mother. Mr. S. Hesketu appeared ifor the-plain tiff, and Mr. W. J. Napier for the defence. The evidence of the complainant was j taken, together with that, of Mrs. Constance, Mr. Chas. Constance, and Mr. Stephen Wells, which went to show that the defendant had never disputed the paternity of the child. Mr. Napier submitted thab tho case musb fail, as there had been no refusal to pay, and, in fact, no application for maintenance had been made since the birth of the child. His Worship upheld the contention and dismissed the case without costs. Mr. Hesketh then announced thab a formal aplication would at once be made. Claim for Rent.— E. Yates v. Joseph Batten, claim £4 15s 3d for rent and damage to property. ! Judgment for plaintiff with costs. A Ke-ikstatement. — wag decided on the application of Mr. Fred. Shortland to reinstate the case of Targetb v. Joseph Batten, a claim for damage to property and which had been previously struck out. HOKIANGA COUNTY COUNCIL. —. — » The Council met at Rawene on Saturday, December 23, Present; Messrs. Burr (chairman), P. Blundell, H. C. Blundell, Harrison, and Holt. Messrs. Galloway and Page took their seats during the , reading of the minutes. County Clerk.—Mr. Holt moved to suspend the Standing Orders and go into committee to consider applications for the county clerkship. Seconded by Mr. P. Blundell and carried. The Council then went into committee, and applications from no less than 25 gentlemen were read, together with accompanying testimonials. After some discussion it was resolved to reduce the number by ballot, with the result that ten names received votes. The six names which stood highest as to number of votes were submitted to the same ordeal, four to be selected. The four highest were Messrs. McLeod, Andrews, Seon, and G. Clendon. On the next ballot Mr. Andrews dropped out; and on the next Messrs, G. Clendon and E. McLeod remained. Mr. Holt then moved, " That the committee report in favour of appointing Mr. McLeod." Seconded by Mr. Page. Mr. P. Blundell moved an amendment, recommendiug Mr. Clendon. Seconded by Mr. H. C. Blundell. The amendment was lost, and the original motion carried. On resuming, the Council reviewed the report of the committee, and Mr. Holt moved its adoption, and that Mr. Ernest McLeod be appointed to the ". clerkship. Seconded by Mr. Page, and carried unanimously. " iv Correspondence.—The outward correspondence since last meeting was read and approved. Inward correspondence From the National Bank, authorising the Council to draw up to £187, the amount of moneys due from Government for work done out of special votes. From the Marine Department (in answer to a request that vessels might be allowed to discharge balk 3t on the foreshore at certain points), stating that it is contrary to law to deposit ballast below high-water mark, and that to make any reclamation required a special Act of Parliament. From the Department of Justice, notifying the intention to constitute the Council of the Bay of Islands Ceuntv the authority to deal with matters under the Alcoholic Liquors Sales Act in the Bay of Islands Licensing District, From the Lands and Survey Department, asking the Council to forward the county map periodically, in order that lands open for selection might be marked thereon, and to allow the clerk to assist intending selectors by supplying necessary forms, and when necessarv, explaining them. Mr. Holt moved, " That the Council will be pleased to accede to the requests." Seconded by Mr. Page, and carried. From Mr. Grey, asking to be appointed pound-ranger at Kohukohu. Mr. moved to reply that, the Council has no intention to appoint a pound-ranger. Seconded by Mr. Page, and carried. /From Constable McGilp, re appointment as Registrar of Dogs. It was resolved to appoint . Constable McGilp sole Registrar of Dogs in the county. From Mr. Ellis, Kohukohu, pointing out that the wharfingers are in arrears with their quarterly payments. Mr. Galloway moved, " That the wharfingers be written to, and told that they must keen up to the terms of their agreement." Seconded by Mr. Holt, and carried. From Mi.'. Ellis, asking permission to fence off n part of the wharf at Kohukohu, with the oonsent of the wharfinger, for the purpose of a grand stand at the forthcoming regatta. The Council was fully disposed to grant this concession, but it appearing that any such action would be altra vires, Mr. H. C. Blundell moved to so inform applicant. Seconded by Mr. Page and carried. From Mr. D. Eynon, re damaged culverts on Atakura Road. Referred to Mr, j Harrison. From Mr. Eynon, complaining of encroachments on the public road at Horeke by Mr. Bindon. Mr. Burr moved, "To request Mr. Biudon to remove certain fencing at once, or the Council would have to do it at his cost." Seconded by Mr. Harrison and carried. From Mr. Seon, wharfinger, at Kohukohu, asking permission to transfer his rights to Mr. A. C. Yarborough for the remainder of his term, and at his own expense. Mr. P. Blundell moved, "That the transfer be not allowed, aiid that if the wharfinger wish to cancel his agreement, the wharf rights be again put up to auction. Mr. Holt moved, " That the transfer be allowed." Seconded by Mr. Harrison and carried. From the Lands and Survey Office, Auckland, returning the schedule of deferred payment thirds, with names of occupiers inserted, and remarking that in future the Council would have to employ someone outside the office to do this. Several letters and petitions re deferred payment thirds were put on one side until the whole question should be gone into later in the day. Tenders.—Tenders were opened for culverts and ditching at Oue. Extension of road to Raruerue Creek (deferred payment thirds), W. H. Beazley, £17 10s; E. Beazley, £14 14s; R. G. Cochrane, £16 ss; Archibald, £14 ss; Phillips, £7. The tender of Mr. Archibald was accepted. Also tenders for the removal of slip at Keretiki: E. Beazley, £8; R. Phillips, £3; R. G. Cochrane, £3; W. H. Beazley, £7 : J. Marriner, £210s. Mr. Marriner's tender was accepted. Reports.— the petition of residents of Kohukohu to have certain repairs done to the planking near the hotel. , Messrs P. and H. C. Blundell reported that the place referred to did not appear to be a part of the public road. Mr. Blundell moved to inform petitioners that the Council have no power to accede to their request. Seconded by Mr. Holt and carried. Mr. P. Blundell reported re timber purchased by Mr. Graham at Pupuke, that the amount paid by the purchaser would probaby cover all the timber obtainable from the sections affected. Mr. Holt presented a report on Charitable Aid matters in the district, and in the County . for the past year. Mr. Page moved a vote of thanks for the clear exposition of the matters dealt with in the report. Seconded by Mr. P. Blundell and carried. Accounts.—Accounts amounting to £73 16s were passed for payment, and Messrs H. C. Blundell and Page authorised to sign cheques for same. Alternative Estimates.— P. Blundell moved, in accordance with notice, " That alternative estimates be prepared for road 3 to connect the Kohukohu township with Tautahihi, and that the vote of £50 for Kohukohu passed last session be earmarked for the purpose of constructing such road as may bo decided on." Seconded by Mr Holt (pro forma). Mr H. C. Blnndell moved an amendment, " That the question of connecting Kohukohu with Tautahihi be left until the moneys voted are secured to the Council." Seconded by Mr Page and carried, Mr P. Blundell only voting "Wo." Thirds.— very clear report and series of statements prepared by Mr. A. S. Andrews with reference to deferred payment and perpetual lease thirds was laid before the Council, and it was resolved, That the lists of available unexpended thirds fnrnished for each riding, should be handed to the councillors for the respective ridings, and that they should, as soon as possible, supply such information as to work required to be done, as should enable the clerk to submit a scheme covering the whole of the unexpended thirds, of which advice had been received." It was also resolved, on the motion of Mr. Page, to accord a vote of thanks to Mr. Andrews for the able manner in which he has done the work entrusted to him. Separate Accounts. — Mr. Galloway moved, "That the clerk be instructed to open separate accounts for revenue and,expenditure of each riding at once.' Carried. Sir.
