Westbourne Terrace, but late of No. 4, Pem'oridge Villas, Bayswater, both in the County of Middlesex, Spinster, between GEORGE FREDERIC ANTHONY and Others, Plaintiffs, and MARK NOBLE BUTTANSHAW, Defendant, Whereas the abovenamed Elizabeth Grove Anthony, by her Will dated the 10th May, I*BB, bequeathed the residue of her estate in trust for all the children of her late nephew Marc Anthony, who should survive her, and the issue of such of them as should be then dead, in equal shares, such issue to take only their parent's share ; and whereas the said Elizabeth Grove Anthony died on the 2(ith November, 1891, and whereas the said Marc Anthony had 4 children only, namely, George Frederic Anthony, Eliza Lomas Anthony, Frank Sheldon Anthony, and Agnes Grove Anthony, and whereas the said George Frederic Anthony, Eliza Lomas Anthony, and Agnes Grove Anthony claim to be entitled to the whole of the said residue on the ground that the said Prank Sheldon Anthony must be presumed to have died in the lifetime of the testatrix without having had issue, and whereas the said Frank Sheldon Anthony was last heard of from New Zealand, in a letter addressed to his mother, dated the 14th October, 1879, stating that he was engaged at a cattle ranche in Tamaki Valley; take notice that the said Frank Sheldon Anthony, and all persons claiming to be entitled to the share of the residue bequeathed as aforesaid to the said Frank Sheldon Anthony or his issue, are by his or their solicitors, on or before the Sth day of JANUARY, 1893, to come in and prove their claim at the Chambers of the Registrar of the Manchester District of the said Court, situate at No. 2, Clarencestreet, Manchester, England, or, in default, he and they will be excluded from the benefit of ad participation in the residuary estate bequeathed by the »aid Will of the said testatrix.
