A DUNE DIN BANKRUPTCY.

[BY TELEGRAPH.— PRESS ASSOCIATION". Dunk din', Monday. At the bankruptcy sitting of the Supremo Court the case of S. G. Smith, butcher, a bankrupt, cams up. A day had been fixed tor his public examination, but. since then the creditors had passed a resolution accepting a sum equal to 10s in the £, and that all proceedings bo discontinued, the bankrupt being recommended for his discharge. The Official Assignee asked for directions as to whether the resolution was to be given effect to. Mr. Justice Williams said it was the Assignee's duty if he had material to indicate that the bankrupt had offended against the bankruptcy law to bring that matter before tho Court. Whether it was his duty to continue tho proceeding* depended on circumstances within tho knowledge of himself alone. These summary jurisdiction sections wore so joined as to be almost a trap, It was difficult to understand or interpret them, and there was perceptible risk that proceedings may be nugatory. After discussion tho case was ordered to stand over.
