PAPAKURA R.M. COURT.
Tuesday, June 11. [Before Thomas Jackson, Esq., R.M.] Hunua Road Boakd Election Petition. —Mr. J. A. Tole appeared for the respondents, and while admitting that the notices •were invalid, and if the petition were proceeded with the election would doubtless be found invalid, yet took objection to the jurisdiction of the Resident Magistrate, on the ground that the inquiry had not been commenced within the fourteen days allowed by law. The Court was not to blame in this instance, as the Resident Magistrate had to attend to so many other Courts that it was impossible he could have sat earlier ; but, nevertheless, he submitted that the Court had now no right to commence the inquiry. Mr. Tole spoke strongly of the careless manner in which the Returning Officer had discharged his duties, and the expense to which his clients had been put by these proceedings. The Court upheld Mr. Tole's objection, and ruled it had now no jurisdiction in the case.
Ross v. Ryland.—Claim for rates, £2 2s. Judgment for plaintiff, costs lis; to be paid in fourteen days. Heard v. Haktnett.-— £15 4s 7d. Judgment summons ; to pay 40s a month, or, in default, fourteen days' imprisonment in Mount Eden.—[Own Correspondent.]
