AUCKLAND CITY COUNCIL.

The meeting of the City Oounoil was held last night in the Counoil Chamber. Present : The Mayor (Mr. Waddel), presiding; Messrs. Laßoche, D. F. Evans, A. Devore, Buohanan, Atkin, Crowther, Holland, Kidd, Gpldie, Phillipps, Dignan, Clarke, Davies, Garratt, Trenwith, and James. The minutes of last meeting were read and confirmed.

NAPieR-STRKKT. —A letter was read from W. Parkinson calling attention to the state pf Napier-street. A memo, from the engineer stated that he had been widening the road, and the work of continuing the road would be gone on with when the ground was settled. Reply to be sent in accordance with the engineer's memo. BtmaESa Roll.—G. W. Jones applied to have his name replaoed on the burgess roll, from whioh it had been omitted in error. Referred to the Legal Committee. Boundaries.—A letter from the Eden Terrace Road Board was read, requesting that the footbridges over the gullies at the boundary of the oity should be pat into proper repair. The Board would contribute half the expense. Referred to the ward members.

NtriSAKOß.—Mrs. Elizabeth Graham drew attention to the unaatisfaotory state of the drainage near her house, Lower Nelsonstreet. A memo, from the Sanitary Inspector stated that the fault originated oc adjoining property belonging to Mr. Partridge. Inspector's memo, to be forwarded as » reply. Emmktt-stiibkt.— George Sale complained of the condition of the surface drain in Emmett-etreet. The engineer reported that it was the result of defective pipes on the writer's own property. Reply to be sent aooording to engineer's memo. Abnky-STRKET.—James Page oomplained of the unsatisfactory condition of Arneystreet, whioh was in the same state as it was 22 years ago. A memo, from the engineer stated tbat footpaths had been made. The coat of metalling would be about £10. Engineer to be instructed to do the work at the most suitable time.

HOBPIT4L Board.—A letter was read from Mr. Garlaud, secretary of the Hospital Beard, offering £20 a year for the use of the small pox hospital. Offer to be aooepted.

OkmetkbT Chapel.—A letter was received from F. y, Wood respecting servioea by Mr. Hill at the cemetery chapel, and stating that they would comply with the requirements of the Counoil. Resolved that the services of Mr. Hill be aooepted as requested.

Drainage.—A letter was received from Annie Johnston asking that the Counoil would execute drainage between her property and the Costley street gully, for whioh she would pay in instalments. Engineer to report upon the probable cost of the work. —A letter was read from W. T. Briggs

drawing attention to a large open drain running in the gully through her premiaes on the east side of Colhngwood-street. A memo, from the engineer stated that a por tion of the work was going on between Napier-street and Freeman's Bay. The Counoil had no pipes leading to the part of the golly referred to. Referred to the Streets Committee.

Claim.—A letter was read from Mr. S. Jackson, junr., stating that he was instraoted by Mr. Ross, master mariner, to make application for'the aum of £56 awarded to him in 1879 for injuries to hie house in Viotoriaatreet by lowering the levels of that street. His client informed him that he was then lessee of the house, and upon the award being made the owner, Mr. Hargreaves, claimed the amount awarded, but the City Couuoil discarded the owner's olaim. From that time to the present his client had made repeated application for the money, but without success. Reply that the Counoil deoline to acknowledge the olaim of Mr. Ross.

J envois Road.—A letter was read from Thomas Gifford and other ratepayers, owners, and occupiers of property in Jervoie Road, asking when the formation works would be commenced. A memo, from the Engineer stated tbat the matter was in the hands of the ward member*. Mr. Devore said the Engineer had made a mistake. The work had been plaoed in tbe Engineer's hands, aud tenders might be called in December. The Engineer was called in, and said the work was on the list to be done next after Ireland-street. Reply to be sent accordingly. Permits.— David Nicoll asked for permisaion to ereot a merry-go-roand with an iron covering on the allotment in Grey-street in his occupation. He enolosed a certificate from residents in the vioinity, stating that they had no objection to the application being granted. A memo, from the building surveyor stated that the applioaat had requested to have the matter deferred for a week, so that he might furnish particulars of the proposed erection. Consideration deferred for a week. A letter was read from A. Todd asking, as he had the contract for erecting tbe Mutual Life Assurance building, Queen-street, to be allowed to fix a hoarding. Kef erred to the Streets Com' mittee. A letter was read from O. B. Rhodes, asking permission to extend the end of Mr. Hill's verandah, Queen-street. Request granted.

Glad.iTone-strbit.—An applioation was made from T, H. White for a few loads of rubble stone to fill in the front of his house in Gladstoue-street. A memo: from the Engineer stated that the house was off the street line. The oost of granting the Application would be about 80s, Application granted.

Union Street.—A letter was read from Johanna Stone, calling attention to the state of the road in front of her house in Unionstreet. A memo from the engineer atated that there had been cuttinga going on, and probably some clay had been carried by foot opposite the property. He had given instructions to have it attended to. r< e ply to be sent in accordance with the engineer's memo.

Petitions.—Mr Kidd presented a petition from etoae-breakers at Mount Eden, asking that old and infirm men chonld be kept on the work. Consideration deferred until the report of tbe special committee on finanoe was dieoussed.

Cook-strkkt.—A petition was received from property owners in Cook-atreet and Eastxitreet, asking for the completion of drainage in that part. Referred to the Streets Committee.

Gladstone Street.—A letter wae read from Messrs. Hughes and George, stating that they had been instructed to write ou behalf of Mr. Samuel Arkle, whose property had Buffered from subsidence of land consequent on works carried out by tbe Counoil in Gladstone-street, and requesting that the injury should be remedied. The engineer reported that a settlement in the embankment had ooourred through the heavy rains on Friday, whioh caused a leakage in the branch water pipe to Mr. Arklo , * pro-. perty. He did not think any damage had been done by the settlement of the embankment. Referred to tbe Legal Committee.

Streets Committkb—The Streets Committee reported as follows :—Letter from tiayden Smith, re water supply to Mary street. Mount Eden: Committee recommend that application be declined, owing to inadequate size of pipe supplying the engine. Letter from H. J. Riordan, re Nelson-street gully drainage : Committee recommend that same be referred to ward members. Letter from C. Ring and other, re (1) formation of footpath in Graf ton Road, and (2) re smoke nuisance: Committee recommend re footp»th, that consideration be referred to ward members ; (2) petitioners will require tn find the necessary evidence under Public Health Act in order to deal with this matter. Petition from residents of Vermont-street (Mr. Evans), re formation (filling in gully) of Vermont-street: Committee recommend that copy of engineer's report be forwarded. Clause 4 of previous report (referred back to committee), re removal of trees in Wellesley street: Committee recommend that two trees only, on the line of Coburg-street frontage, be cot down.—W. Cbowthkr, Chairman."—Adopted with the amendment that the trees recommended to be out down be Noi. 7 and 8 from Lome-street.

Finance Committee.— The Finance Committee report m follows . —Circular from Colonial Treasurer re Local Bodies Loan Act, 1836 : Your committee report that this Act is npt applioable to Auckland. Letter from J. Symons, hon. secretary New Zealand Art Students Association, re use of Ait Gallery room for day exhibition, November; Committee recommend that charge be £2 2s per day. Letter from F. Brown, re license public oonoert room Until tbis building is altered in aooordanoe with the regulations committee oannot recommend the issue of a lioense.—W. R. Waddbl, chairman. . Mr. Goldie moved that the sum of £1 Iβ instead of £2 2s be inserted as the charge for the Art Gallery room, but subsequently withdrew his proposal. Mr. Holland moved "That the request be not granted as the iding was nob completed," Mr. Cooper

seconded the motion. The amendment after a short discussion was carried, and the report as amended was adopted. . Lkgal Committbe.—The Legal Committee reported :—Letter from J. J. Craig re Mount Eden reservoir site: Ground held by him under lease from Domain Board. Letter from Chairman Mount Eden Domain Board read : Committee recommend a reply in terms of Domain Board's communio»tion, viz., that Mr. Craig be referred to Domain Board, by whose authority the contractors for reservoir are occupying the ground: neoeeaary for reservoir purposes. Letter from Champtaloup and Cooper re boyke for Library : Committee recommend that list as selected by librarian be authorised, at a coat of about £25. Re books, patents register: Keoommended that laet three years' American and English editions bo procured, and hence annually Letter from Whit*ker andßuseell re tramway agreement.- Committee recommend that the following amended conditions be forwarded to solicitor to be embodied in the new agreement: Time for completion of oironit to be extended to two years trom date of signing the deed, penalties thereafter to be £6 per week. Deed of mortgage to include all former conditions of contract, and oot to prejudice Counoil's rights under former deed. Concession re Queen-street (upper part) to be for horsed oars only.—A. DβvObb, Chairman. Mr. Garratt moved with refereuce to. clause 4, recommending th« extension of tnn for penalt es incurred by the Tramway Company be explyded from the report. "Let them trust to the honour of the company to complete their work, and not to iuflict penalties juat to remit them. Mr. Liißoche aeconded the amendment. Mr, Goldie thought it would be a mistake to omit the penalty clauses, but they could relieve the company from liability -whenever they saw good cause for doing so. The amendment was lost and the report then adopted.

Tendbb9. —The following tenders were received for works in London and Dunedin Streets: John Simon, £334 12s; Eugene Murphy, £330; P. Regan, £327 ; John Ching, £411 16s 7d ; M»gee and Co., £363 9a 6J ; Thomas White, £355 0s 2d ; John Leydon, £322 7a. The Mayor stated that the tenders' were below the Engineer's estimate. The tender of John Leydon was accepted, the amount to be charged to the Ponsonby allocation. The half-yearly accounts were laid upon the table.
