In tßis case, the plaintiffs witnesses not being present, Mr. Dignan applied for an adjournment Jto the following Court day.—Mr. Whitaker, I for the defendant, agreed on the understand" ing that his witnesses should be paid coats for the day. Mackie t. Snipscw.—Ciaim £3 7» 6d. Mr. Theo. Cooper appeared for the plaintiff. Xhii Was a claim for work and labour done, and judgment was siven for the amount claimed, with costs 26s 6d. Lynch v. Turner; — Claim £10 4s id. Mr. Napier appeared for the plaintiff, and Mr. George for the defendant. The plaintiff is a carpenter, and sued the defendant for certain money due as wages, the correct amount being in dispute. Judgment was 1 giyen for £9 09 6(3, with costs, £5 3s. Jaklns t, Kamo Collieby Company.— Claim, £10 10s. Mr. Campbell for the plaintiff, Mr. Theo. Cooper for the defence. Oh the application of defendant's connsel, the case was adjourned till half-past ten on next Friday morning. I " Official Assignee t. "Bukke'li.—Claim, £4 5s Bd. Mr. Cave appeared for the plaintiff, and asked to have the matter adjourned till aext Thursday, in consequence of the absence of a material witness. Adjourned accordingly. Wμ. Homes v. C. VV". Langstose. Claim £35,, for a breach of agreement. Mr. Theb. Cooper appeared for the plaintiff and Mr. Cotter for the defendant. This was an action brought against defendant as owner of the brigantine Nightingale, 230 tons, and who engaged plaintiff on the 18th of September as captain of the vessel from the date of her expected arrival at Dun' edin, and until then agreed to pay £1 per day to plaintiff as retaining money. On October .22 defendant told plaintiff he would have to go to Donedin by the steamer to take charge of the Nightingale, and defendant was to go with him. At the last moment, however, the defendant said ho had no money, and backed out of the matter. The present claim woa based upon the agreement made, Robert Long, barman at the Nevada Hotel, Mm. Homes, wife of the plaintiff, and Mrs. Baker, were examined in corroboration of the plaintiffs caae. For the defence it was urged that from 12th to 26th September defendant was not in Auckland, but in fielensville, where he made an arrangement for the purchase of a brigantine, on the 17th Sept., and Capt. Short was to remain in command. He saw plaintiff in Auckland, and was asked by him for employment. Mr. Langstone said some others were going to join in the purchase of the brigantine, and if the plaintiff liked to put in £100, as an eleventh share, he had no doubt he could obtain employment on board of her as mate and carpenter. .There had been no agreement to engage plaintiff ss captain nor to pay him one pound a day. It was intended to ran the Nightingale in the New Guinea trade, and Captain Holmes was not entitled on his master's certificate to command a Teasel outside New Zealand waters. In addition to the defendant, Thomas Harkiss, commission agent, was examined on behalf of the defence. Counsel having addressed the Court, at the request of plaintiff's conned the olaim was amended to £23, and Hie Worship reserved judgment.
