[BY TBL2GBAPH. —• PRESS ASSOCIATION.] Kumaka, Saturday. An important. decision was given in the R.M. Court to-day. George Simmonds was summoned by George Stewart, who claimed £50 penalty for S'.mmonds acting as Borough. Councillor when ' incapable under the . 4tti sub-section of the 61st section of the Municipal Corporation Act, 1876. Br. Gilles, K.M., gave judgment for the plaintiff, and said : " It cannot bedisputed that tbe work in the present cise vyas done for tbe Council and paid for by the Council, and I aui afraid nothing has been shown- which could ■ relieve | the defendant from the penalty. I regret, that I have no power to mitigate the penalty,: but it appears to me that the plaintiff is entitled to judgment for the amount claimed, with costs." In another similar case brought against Simmonds undef the same clause by Duncan MoClennan, another penalty of £60 and costs was inflicted
