In tto District Court yesterday, Samuel Wade, the licenseo of Brunton's Hotel, Sp»infatreet, was proceeded again't by the excise officers for soiling gin In sclinupps bottles as the genuine article. Mr. Purves prosecuted, and Mr. Dcmain defended. ExclseoQicer Rattray gave evidence to tho cifeet that on the Bth instant, he called at Wade's Hotel with Eiciseolflcer Itoche, and asked for Wolfe's schnapps. Wade produced a bottle, and, aftcriaatlng the contents, the oflicors came to the conclusion that it was not schnapps, and Wade then admitted it was gin. On being tested the liquor was found to be 38 or 39 , degrees under proof, whi'e the gennino article was 14 only. Wade said he kept the gin In the bottle for hot grog only. Excise-ofllcer M. G. Roche g&vo similar evidence, and produced a certificate of the i registration of Wolfe's schnapps trade mark in this , colony. Joseph Symonds. wine and spirit merchant, ! stated that the liquor in dispute was J.D.K.Z gin and water. It would cost about Is 10Jd per bottle, while the genuine schnapps would cost about Ss Cd. Tho , Inferior liquor was harmless. For tho defence, Mr. Demain submitted that there was no Intention to defraud on the part of his client, who had told the officers beforehand what the bottle contained. Joseph Clarke and Robert Mason, waiters, were called to prove this, and stated that they heard Wade tell the officers that he had put the gin in thobottla i because he had broken another bottle on the previous day Charles Robson, another waiter, said ne heard Wade say, " Mind, lam selling you gin."
