Evory Owner or Driver or Conductor of a Borough Stage Carriage permitting the same to carry passengers or ply for hire without having the number of persons whiclraccording to the License may be carried by such Borough Stage Carriage painted in words at length and in the prescribed form on a plate placed on some conspicuous place on the outside of such Borough Stage Carriage so as to be clcarly distinguishable or who shall permit to be carried on or by such Borough Stage Carriage a greater number of persons than the number which according to such License may be earned. 3. Every Owner Driver or Conductor of any Vchiclo llackney Carriage or Borough Stage Carriage permitting the same to ply for hire after sunset and before sunrise without having such Vehicle Hackney Carriage or Borough Stago Carriage provided with proper carriage lamps or without keeping such lamps properly lighted. 4. Every Owner or Driver or Conductor of any Borough Stage Carriage permitting the same to ply for hire without having a carriage lamp placed and kept insicte such Borough Stage Carriage and at the opposite the entrance door thereof or without having such lamp properlv lighted whenever such Borough Stago Carriage shall be used to ply for hire or carrying passengers at any time after sunset and before sunrise or permitting any person to smoke whilst inside such Borough Stage Carriage or permitting such Borough Stage Carriage to ply for hire without the words "No Smoking Permitted" being printed in legible letters of at least one inch in length and of a proportionate breadth posted inside such Borough Stage Carriago. (16.) —Penalties. Every breach non-observance and non-fulfilment of any of the provisions of these Bye-laws shall be an otfence punishable as hereinafter mentioned that is to say for every such offence the offender shall upon conviction be liable to and shall pay a penalty not exceeding five ponnds to bo recovered in a summary way by any Justice as by law is or shall be provided. Provided that when by these By-laws any penalty is imposed upon the owner driver and conductor of any carriage for one and the samo offence only one prosecution shall be had or maintained for the recovery of such penalty against such owner driver or conductor at the option of the informant.
