PAPAKURA R.M. COURT. —MONDAY.
(Before R. C. Barstow, Esq., R.M.] Civil Cases.—McMillan v. Waters, claim £7 ; amount admitted, but a cross action for £S, costs to abide result.—W. Routley v. Joseph Scott, claim £25 10s, for damages and removal of 10 J chains of fencing from his boundary fence, on the Tuakau Road. Mr. Hesketli for plaintiff. It appears that the Tuakau Road divides the farms on the one side, and a blind road on the other ; and that some years ago, to save the expense of erecting double lines of fencing, a joint fence was erected on Scott's land on the blind road, and on Routley's land on the Tuakau Road. Scott now wanting to fence his line on the Tuakau Road, required Routley either to erect an equivalent on hi 3 line, or pay for the portion which had been put up by him. This Routley declined'to do, having already put upon the blind road on Scott's line an equivalent, whereupon Scott removed the fence put up by him ; and hence the action. The facts were admitted, but Scott alleged that as the fence encroached on the road, he thought he could remove it. Judgment for plaintiff £10 10s, for value of fence, £5 damages, costs £9 Gd : total, £24 lGs.—Walter and wife v. Geldaru, claim £9 18s OJd. Judgment for plaintiff £7135; costs 14s.
