Herbert.—Mrs. Francis Gardiner, being eworn, said : 1 em the wife of George Gardi ner, and residu at Pokeno. Mrs Janet Kelly, being eworn, eaid : I eaw the plaintiff and defendant ttrupgling together outside the whare. After a little time I went down to eee what was the matter, and on going into the wl.are, I fauna the ~laintiff on the floor, and the defendant witn his knee on her stomach and his hand on her throat. The blood was coming from her mouth. I immediately went out and called for assistance I understood the whare to belong to Mrs. Gardiner. J. his closed the prosecution. The defendant said, in his defence, that he had hired the whare from Mrs. Gardiner, in payment of money due to him from the plaintiff, and that he hud come to knock the whare down ; and when he went outside she swung the axe at him, and ho had b> disarm her lu aelf-defcnee ; that she followed him inuo the whare, and fell over a bag of potatoes.
