GENTLEMEN,— It is with personal regret, but under a sense of duty, that I inform you I havo transmitted to His Honor tho Superintendent my resignation of the scat in the Provincial Council, to ■which you did mc the honor to elect me. Since my election a question has been raised as to whether or not I am disqualified from taking my eeat under tlio Disqualification Act of 1858. The legal opinion which has been laid upon tho table of tho Council, although generally favourable, still leaves the question open to doubt. As an officer under tho General Government I feel that I Bhould not be justified in doin,j whut, by the remotest implication could, by reason of my official position, be open to question, morally, even if not legally. I havo carefully considered tho position in which I am placed, and have consumed with friends upon the subject. The result has beon that with a duo regard to that position, I have no option but to adopt tho course which I havo taken.
