RESIDENT MAGISTBATE'S COTTET. (FEOSI OUII OWN CORBKSPONDENT.) (Before Captain Mellsop, 8.M.) August 26. WOOLWICH Y. THOMAS. Claim, £10. This was a claim for the value of a horse belonging to plaintiff, and "was last seen in possession of defendant on the night of May last. Defendant denied his liability. Peter Woolwich, sworn, deposed: I reside at Point hnssell. I have been in the employment of the Messrs. Quick. I had a horse in May last. X have not seen him since. He was then running at large on tbe Koheroa ranges. I searohed for him for five days but could not find him. Thomas Pelican told me he saw defendant riding him between Maungatawhiri Creek and Queen's liedoubt. I then called on the young man, but I got nothing but nsolence from him. I then went and got a summons against him. To the Bench: Ido not know where the borse is now. I have not sold him to anybody.

Thomas Pelican sworn, deposed : I reside on the other side of the Waikato river, about four miles from Point Russell, and am in th© employment of a Maori. Between 7 and 8 o'clock one evening in June last, I saw defendant getting off plaintiffs horse at Mr. Jenkins's flax-mill, near Point Bus9ell. I did not know at the time he was plaintiff's. I thought he was Mr. Quick's. I saw the horse two days after, running at large near the creek. I have not seen him since. Defendant, a young lad, about 15 or 16 years of •ge, being sworn, deposed: lam in Mr. Jenkins's employment at the flax-mill, near Point Bussell. My master told me to drive away the horse in question. He was annoying us always about the mill. He did not tell me to ride him away. I did not know whose horse he was. I have seen on che run three days after. Ido not know where he ia now. John Jenkins Bworn, corroborated the eTidenco of the defendant. His "Worship then B&id there was no evidence to prove defendant took away the horße, and therefore he dismissed the case. MBSSIDEB V. CAMXBOX. Claim, 45., for goods supplied. Case adjourned till Monday, 2nd September, at Drury. MCNUBBAY V. PHtLPOT. Claim, £1 25., balance of account. Settled out of Court.
