RESIDENT MAGISTRATE'S COURT—April 22. (Before Major Speedy, R.M.) beowxixg v. TOY. This was a claim for £9 7s 6d. for trespass ami damage done by from 20 to 25 pigs on tbe enclosed land of the plaintiff at Brooklands, ne;ir Waiuku, on Wednesday, 27th March, and Monday, Bth April. William Currie appeared as agent for Mr. Browning and deposed as follows: —I gave authority to William Walters to take care of the place. He has ca'led on mo several times about the pigs belonging to Mr. Udy being continually on the place. On ono occasion I went up to see what damage had been done. I found all the new grass eaten close down, and some pulled up; also saw twelve of the defendant's pigs in there, and sent word to him that I would summon him unless he kept them away. I told Walters tho next time he saw them there to get some witnesses to see them, and let mo know. In cross-examination by the Court, witness said the land in question wa3 all fenced. Char'es Green deposed that while engaged above a fortnight in ploughing on Walters' land, close to plaintiff's, he daily saw pigs on the land. Ralph Gracie deposed that while at work at Walters', his attention was called to tie fact of Udy's pigs being on the place. William Banday deposed to nearly the same. William Walters deposed that he had frequently seen Udy's pigs on the farm of Mr. Browning, and at various times had called defendant's and other persons' attention to tha fact. Defendant, Sender Udy, said ho believod his pigs had been on tho farm of Mr. Browning, that he had notice to that effect from Walters. He further contended that he kept his fence in good condition, to prevent tho annoyance. Two of his labourers gave evidence that the fence was repaired as soon as possiblo after tho trespass, but could not deny the fact c-f the pigs being on the place. Judgment for plaintiff for £4 13s. 9d. and costs. On Tuesday, the 23rd April, the Annual Licensing Meeting took place at Waiuku, before Major Speedy, E.M. (presiding), and O. Mellsopp, Esq , R.M. Renewal licenses wore awarded to :— Archibald Campbell, Campbell's Hotel, Waiuku. James Pike, Mauku Hotel, Mauku. Kdward Constable, Kent Hotel, Waiuku. James Steadman, Harbour Hotel, Port Waikato. The license of Port Waikato Hotel was transfered from Mr. Williams to Robert Mitchell. Messrs. Constable, Steadman, Pike, and Mitchell, made application to have their license fees reduced on account of the dullness of the times, asserting, and probably j with great truth, that their present trade did not pay expenses. The Berch, however, did not accede to their requests. I
