To the Editor of the New Zealand Herald.
Sin, —About twelve months a«o, in an evil hour, I entered into a contract with Eric Craig for the erection of a hou-e and shop in Newton. Before the building wag finished Mr. Craig became insolvent, and my building was temporarily abandoned, to my grievous loss, having made arrangemonts to let the building at the time epeciiied, according to agreement, for completion, and which agreement was not fulfilled, as the time allowed for completion was exceeded by soven weeks. When I tendered payment to Mr. .Atkin, sen., then agent (less deduciion of £10 10s , boing seven weeks' demurrstge, at 30s. per week, as per said agreement), Mr. Atkin refused the money, having instructions to obtain the full amount, and I tendered payment more than once. It is upon this point I feel aggrieved. When my case was brought before the .Resident Magistrate, instead of mv solicitor pleading the Bet-off, he allowed judgment to go by default. I am not now in a position to pay tin money, even if i. felt so disposed, but consider that I have been both unjustly and harshly used.
