The br.u daries of the 1 istrict are on the North, the Northern boundary of Lot 1 of the Parish of Waipireira ; on the East, the Waitemata Creek and Harbour, ihe Wnau Creek, a>d the Whau Portage ; on South the Munukau Harbour; on the "est, the Sea; amd on the North-west, the *orth-western boi-.ndury of tho Waitakerei Block, the Wtirere fctreum, the Western boundary of the Pariah of Waipareira, and the Ku« meu Stream. CONDITIONS. (Applicable to all the preceding contracts.) Samples of the various articlei to be supplied will have to be submitted for iuspection, if required. The Contractors for supplies will be required to deliver the same from timo to timo at such places, and in such quantities, as may bo indicated by the Superintendent. The Contractors for the performance of any work or service will be required to perform the same as it may be ordered for the Provincial Government by some Officer authorised by the in that behalf. The Government doos not bind itself to accept tho lowest or any of th« t3iiders sent in. Any of the contracts may beannulled upon the expiration of one calend .r month's notice, in writing, of an intentin to discontinue the same, to be given bv the Contractor on the ono part, or by tho Superintendent, or by some person authorized by him, on behalf of the Irovincial Government, on the other part Payment of any of the above supplies, works, or services will be made monthly, after the bills have been rendered in a complete stato by the Contractor, and passed. Tenders to be scaled and endorsed "Tender for (name of article or service.)" In the i rpnt of a difference of opinion between the Contractor an.; 'he Officer receiving the supplies, the same is to be deciJcd, in cases where the artiole is not of a perisLalle jmture, by a Board of Surrey composed of persons ..amed by the Government. If the Board shall decide that the article is not of a rioper quality, it must be immediately replaced by tho O ntractor, failing which it will be procured by the depa; tmeut requiring it, and the expense charged to the Contractor. In cases where the article is of a perishable natare, or in which, from some other cause, injury would be sustained by waiting for a Board of Survey, the head of the department, or Oilieer in c' arge, for whom the supplies are 11 bo received, shall have power to leject any article of a quality inferior to the approved sample ; and to purchase others at the expense of the Contractor. In the event of the Contrac'or for the performance* of any work or service being dissatisfied with -he decision of the Officer in condemning tho same, the Superintendent will, upon the written request of theContractor, made immediately after such decision,, and the Superintendent may nlto, at any time, without such r. quest, summon a Board of Survey toexamine any work ; and if such Board of Survey shall declare any sucli works to be infeiiorin quality to the work conhacted for, or otherwise improperly done, tV.e Contractor, upon notice thereof, shall immediately rep ace eu< h work by other, s.tisfaetory to the Board of Survey; and in default thereof, the Superintendent, or some officer authorized by him in. that behalf, is herer.y authorized to procure such work to be replaced in any manner lie may think fit, and the Contractor shall'bear and pay to the Provincial Government all costs, charges, and expenses attendant thereon, as well as any excess of price for the same, together with a su'u of money, by way of penalty, equal to one fo.,rth of such costs, charges, and expenses, and excess of price, all of which are herebv nade chargeable on any sum which may bo duo from tho Provincial Government to tho Contractor. The tenders (forms of which may be obtained at this Office) to contain the names and places of residence, at length, of the persens tendering, are to ba signed by two respectable sureties, tngagiug to bec«n» boud in a penalty of £100 for the fulfilment of the contract if tho tender bo accepted, and no tenders will be received unless upon Buch forms. All contract bonds must be signed by the oea« tractor and his sureties before the date of entering upon the contracts. No rorion whatever holding any situation of profifc nr emolument under Her Majesty's Government of New Zealand, or under the i-oyernment of thift Proving, shall bj a party, directly or indirectly, to any Contract.
