CAUTIO N. ri EEVRAL persons having settled upon * land belonging to the undersigned, at Wangurei and Waipu, on the ground of having paid money for the same to the officers of the Colonial Government, the undersigned thinks it necessary to renew his notice lo such persons, and lo all others whom it may concern, that the Government of this Colony cannot give a legal title to the lands in question ; and that any expenditure such persons may make upon such land will be at their own risk, as he will in no case whatever recognise any claim on the ground of such expenditure. The Chief Justice of Now Zealand, in the case of Busby v. McKcnzio. has laid down the doctrine that, "as a British subject, cannot be permitted to question the validity of British Law in a British Court of Justice, so a colonial subject of the Crown cannot be permitted to question the validity of Colonial Law, in a Colonial Court." It is the intention of the undersigned to appeal against this doctrine to the Judicial Committee of the Privy Council. It is not for him to express an opinion whether or not it was the duty of the Chief Justice lo take judicial notice of Ihe repugnancy of the "Land Claims Ordinance" to the law ofEnglaud, and of its being by season of such repugnancy "apretended Ordinance, having no force or validity," but he has no doubt whatever of the right of a British subject lo the protection of British Law against the illegal enactments of a Colonial Legislature.
