NOTICE is hereby given that, whereas the Undersigned was induced to purchase fiom ccitain Native Chiefs of New Zealand, their light and title, and that of their Heirs and Successor*, to certain Islets known as the MoROTim or CmccFNs, the Pokohinu or*Anvls, and the Te Witi Rai or Poor Knights by vhtue of Pre-emption Certificates, No. 152, dated 27th January, 1845; No. 187, 10th Febiuary, 1845; No. 1 79, same date— which were issued in favour of the Undersigned in accordance with a proclamation issued by Governor Fitzßoy, with the consent of his Council, on the 10th October, 1844. And whereas instiuctions from certain of 11. M.'s Secretaries of State for the Colonies have recommended to H. E. Governor Grey, the early settlement of the Claims arising from the aforesaid Proclamations, which purchases were undertaken, as in the above cases, solely on the honour and good faith of the British Crou n ; H. E. Governor Grey has not only lefused to settle the said claims, but has descended in his despatches to H. M.'s Secretary of State for the Colonies to give statements and inferences, calumniatory to the Claimant ; as derogatory to H. M.'s Representative, as at variance w ith the facts. And whereas H. E. Governor Grey has of his own accord, given to an individual named Isaac Merrick, a Lease for 21 years of a portion of the above Islets. This Notice is to Caution the said Isaac Merrick, and all other person or persons, from leasing in anywise, the whole or a portion of the Islets comprised in the above groups, as H. E. Governor Grey has not the remotest claim hy purchase on the part of the Local Government— or power as a Governor of the Colony— or as an individual—to give or grant such lease or leases to any person or persons whatever, and as it is the intention of the Undersigned to lay this oppressive case personally before H. M.'s government, and further, institute in British Courts of Law a demand for compensation from Sir George Grey, at present Governor- in-Chief of New Zealand, for the losses occasioned the undersigned by his arbitrary and unconstitutional conduct, Notice is therefore given, that the same redress will be resorted to by the undersigned against the said Isaac Merrick, and against any persons who may purchase, barter, receive, or use in anywise, any of the oies, minerals, or other produce or portion of the above Islets, whether by virtue of pretended leases, or similar permissions of any individual.
