RESIDENT MAGISTRATE'S COURT. February 14th. (Before T. W. Parker, Esq., R.M.)
OFFENCE AGAINST THE TOWN AND COUNTRY POLICE ORDINANCE. Andrew Baker was charged with allowing tho drainago of his premises to run into the water channel of Tyne street, thereby creating a nuisance. Mr Baker acknowledged the charge to be correct, but said he could not avoid it, aa there was nowhere else to run the drainage to. If he closed the «ewer complained of, a nuisance would be created on bis premises, and for that he would also be liable. Mr Gibbs, a member of the Town Board, waa called by complainant (Sergeant Bullen), and stated that thechannel in which the nuisance existed waa never intended as a public sewer, but merely as a surface drain to carry the water off the street into the main sewer, and so to the beach. His Worship, after some remarks relative to the insufficiency of the drainage in the town, {aid it was very hard that the community should suffer from this nuisance, and at the same time it was equally hard on the defendant to be compelled to shut this cewer up. Ha would adjourn the case to Friday, the 24th inst. for tho purpose of ascertaining what action the Town Board would take in the matter. Mr Baker promised to have the nuisance abated.
