FAILURE TO STOP
OFFENCE AT LEVEL CROSSING Remarking that this was the first offence of its nature to come before him the Magistrate. Mr T. E. Maunsell. yesterday fined Ethel C. Gunner (Mr K. E. Knapp) £3 and 10s. costs for, being the driver of a car, failing to comply with the direction of a railway employee at a level crossing in Gloucester st. A plea of guilty was entered. Sergt. J. R. Corston. for the police, said that defendant was driving west along Gloucester st. There was. at the railway crossing, a railway employee, who was signalling the approach of a train by holding up a large “Stop” sign. Defendant did not stop and the railwayman then waved a flag. Defendant almost ran over the employee. There was no question of excessive speed, defendant’s explanation being that she did not see the man signalling. Mr Knapp said that his client did see the man with the sign but it was alongside him and not Held aloft and she proceeded to go through. The Magistrate said that the court must lake a view of the offence.
