UNLAWFUL ENTRY

AT HOME IN STRANGE HOUSE [United Press Association AUCKLAND, 10th January. A young man who had been found lying on a bed in a house during the absence of the occupants, smoking a cigarette and listening to the wireless, appeared before Mr Levien, S.M., in the Magistrate’s Court, Auckland to answer a charge of beir found without lawful excuse on premises at B‘*l Dominion Road. Accused, James Peter McNamara, aged 26, who was

defended by Mr Aekins, pleaded guilty. Detective-Sergeant McHugh said that on 23rd December, while the tenants of the house were away, a neighbour saw McNamara entering by way of a fanlight. The neighbour called out and he went away, but the neighbour later heard the wireless going in t’ i house and rang up the detectives. Detective McLean found him as described. “We are satisfied he did nc'. go there to commit burglary,” said Mr McHugh, “because nothing was taken or disturbed.” At first the police thought he was mental, and had him examined by a doctor, but the doctor said there was nothing wrong with him. He had a clean record and was well spoken of. Mr Aekins said McNamara had been

in custody for a week and he would be going into camp on Friday. He had been drinking heavily. Counsel suggested that the case should be adjourned for three months.

Remarking that this had been a foolish escapade, the magistrate took the course suggested.
