The principal witness, Pascoe, stated in the course of examination, that he did not know Foley. He had not been in his company on the day of the tragedy nor was he in the car at the time of the accident with Pascoe. Under police pressure, witness acknowledged that his previous statement was untrue, giving the excuse that, as Foley was more drunk than sober, he thought it inadvisable to state the actual facts.
