CHARGE OF ASSAULT
SEQUEL TO BETTING TRANSACTION ACCUSED FINED £5 CUnited A-—call, ml AUCKLAND. This Day. "The £lO was a bet on Gay Vixen, but I think on this occasion it was a ‘Sly Fox,’” said Mr W. Meek, defending a bricklayer, John Rowland Howe, who admitted a charge in the Police Court of having assaulted Eric Ashby on 27th October. It was the sequel to a bet on a horse which won at Gore on 22nd October. The horse paid the limit, but Ashby did not get paid. The police said that Howe had apparently been bookmaking. Ashby, who had put £5 each way on the horse, called at Howe's house and claimed £6O. Howe said he had no intention of paying the bet as Ashby had telephoned after the race had been run Words ensued and Howe kicked Ashby on the shin and groin. Ashby complained to the police. Mr Meek said that Ashby telephoned Howe’s wife at 3.35 o'clock, and put ! £lO on the horse. Mrs Howe accepted j the bet but later found that the race was run at 3.10. Ashby had never before had a bet with Howe. When AshI by called Howe was very drunk and did ! not remember much of what happened. Mr Orr-Walker said there must have ! been aggravation and fined Howe £5.
