NELSON DIOCESAN BILL HELD UP JUDGE’S CERTIFICATE SHOULD BE OBTAINED [f.v (By Telegraph—Press Association) WELLINGTON, 18th September. The Legislative Council met at 2.30. The Auckland City Abattoir Bill and the Nelson Waterworks Extension Amendment Bill were read a. ' first time and referred to a Select Committee. The Council refused to suspend the Standing Orders so as to allow the Nelson Diocesan Trust Board Empowering Bill to proceed i, The Speaker, Sir Walter Carncross, pointed out that a Judge’s certificate should be obtained, and if the Standing Orders were suspended in this respect, the Supreme Court would be flouted. The Fisheries Bill and the Law Reform Bill were passed.
The Statutes Revision Committee, to ' which the Law Reform Bill was referred. deleted a clause providing that s'; covenants in leases are not to assign without a license or consent if lease is for more than forty years and was made in consideration of building improvements under certain conditions;’ The Council adjourned till 4 p.m. on Wednesday. .■

The Nelson Diocesan Trust Board Empowering Bill, met with a swift fate in the Legislative Council yesterday afternoon. 5 ;-• « The Hon. W. H. Mclntyre, Who was in charge of the Bill, moved that the / Standing Orders be suspended so as to allow the Bill to proceed.The Speaker (the Hon. Sir Walter Carncross) drew attention to the fact that the Bill was a private estate Bill, and pointed out that a certificate was required from a Judge of the Supreme Court in terms of the Legislature Act, 1908. :
Sir Walter said that Mr Mclntyre’s motion was tantamount to asking the,, Council to convert all its Standing Orders affecting private estate Bills into scraps of paper, and would result in the flouting of the Supreme Court.' ; “I recognise that I am the servant of the Council, and that any ofder they make must be given effect to,' but I consider that I should have' absolutely failed .in my 'duty if I had not drawn pointed ’ attention to • the position as I view it,” he said.
