ADMISSION TO UNION
WATERSIDER’S CLAIM VERDICT FOR DEFENDANT (By Telegraph—Press Association) WELLINGTON; 23rd April. Judgment in a case heard at Napier has been delivered by Mr Justice Reetß A wat'ersider, Edwin Charles Batt; sought a mandamus to compel , the Naf pier Watersiders’ Union to admit him to membership, and also claimed £3OO damages for loss of employment. Plaintiff was a member of the union before the earthquake, and afterwards he was transferred to New Plymouth. He sought re-entry, and his application with 200 others was dealt with in January last year, and refused on the ground of character, and that the Union had since the cancellation of the award unfettered discretion to limit membership. His Honour said suspected character was not a real reason for refusal. Nevertheless Clause 4 gave the union executive discretion in the matter of'admission to membership. Hence the Court had no jurisdiction. Judgment . would accordingly be for tile union. He presumed there would be no application for costs.
