PROHIBITORY ORDER CHARGES AGAINST O’DUFFY. (United Press Association— By Electric Telegraph—Copyright) (Received 25th January, 1.30 p.m.) DUBLIN, 24th January. The Attorney-General, Mr McGuire, applied to the High Court to remove with costs against General O’Duffy the prohibitory order. The Court was crowded, 'With a full bar on both sides. Mb McGuire, replying to Mr Justice : Hanna, gave an interpretation of the legislature’s intention regarding the creation of a tribunal and the scope thereof. Air Justice Hanna pointed' out that membership of an unlawful association was an offence, but the summons-against O’Duffy'indicated a retrospective offence. No Act of Parliament could be retroactive. The hearing was adjourned. A Dublin message dated Ist January stated: — The High Court granted a con ditional prohibition preventing the military tribunal hearing or determining The charges against General O’Duffy on the ground that the charges were outside. the tribunal’s jurisdiction; also that the charges of unlawful association did not involve a legal offence. ,The AttorneyGeneral and the tribunal must now show cause for the charges.
