RECKLESS DRIVING
TWO YEARS’ REFORAIATIVE DETENTION (By Telegraph—Press Association) AUCKLAND, 12th August, “You are very optiipistic; your client has been convicted of attempted murder, you know,” said his Honour Air Justice Smith to counsel making a plea on behalf of Albert Edward Best, who was brought up for sentence for negligent driving, causing death. Counsel replied that the case referred to by his Honour was deliberate, and the present offence could not be similarly classed. The man who bad been killed was a friend of the accused, and was a passenger in bis van at the time of the accident. In view of the fact that the offence was not deliberate counsel asked bis Honour to deni leniently with the accused.
His Honour (to the accused): “You have been found guilty of driving in a reckless manner and causing death. It- appears that you were reckless and under tho influence of liquor. I acquit von of any deliberate intention to kill your friend, but- the manner in which you ran into the lorry showed an utter recklessness and disregard of danger. In view of tho circumstances I would not admit you to probation, and in view of your record I could not. You will bo sentenced to a period of reformative detention not exceeding two years.”
