CARRIAGE OF MACHINERY
COURT PROCEEDINGS

CHRISTCHURCH, April 8.
The carriage of a quantity of machinery from Nelso-n to Lyttelton or. as r. parly claimed, the failure to fulfil the contract, was the subject of a dispute before Mr Wvvern "YViison, S.M., in the Magistrate’s ‘Court. Piteaithly Bros, claimed from the Zealandia Milling Co. the sum of £2l/3/4, and there was a counter claim of £l4. The statement of claim set out that the. amount of £2l 3? 4tl was owing for freight for the conveyance of goods in the steamer Cygnet as requested by the defendant company. In the counter claim it was stated that on or about June 1923, the plaintiff company contracted to carry certain machinery," amounting in all to between 50 and 60 tons, from Nelson to Lyttelton, at 25/ a ton. The plaintiff company carried n portion of (lie machinery, but in December refused to complete the contract or to carry any more of the machinery. Tn consequence of plaintiff company's default the defendant company incurred losses amounting to £l4. being demurrage charges incurred in Nelson. Judgment was given by consent for Piteaithly Bros, for the amount- claimed, £2l/3/4.”and on the counter-claim judgment was given for the Zealandia Milling Company for £l4.
