TASMAN ORCHARD CASES

BEFORE COURT OF APPEAL

WELLINGTON, This Day. The Court of Appeal commenced this morning the hearing of argument in two cases of the Tasman Orchards Co. v. Piggford, and the Tasman Orchards v. Thompson. The two were , similar an were heard together. Mr Myers, K.C., with him Mr O’Leary, appeared for the appellant company, and Mr W. Nicholson, with him Mr C. R. Fell, for the respondents. In the Supremo Court the respondents had been awarded damages for misrepresentation in connection with, the sale of certain apple lands in the Tasman district.

Mr Myers, for the appellant company, said it would be maintained, first, that there bad been no misrepresentation, and second, that damages had been assessed on a wrong basis. " ■ It is expected that argument in the ease will last all the week.
